CBDT to continue to enjoy phone tapping power
NEW DELHI: The Central Board of Direct Taxes (CBDT) will continue to benefit from the power of wiretaps despite a strong recommendation of a Committee of Secretaries against it following a controversy in the wake of the episode NIIR Radia.
"The CBDT will continue to have power subject to wiretapping to certain conditions," said an official.
However, it is not immediately clear the conditions of the CBDT will have to complete before tapping the phones of everyone.
The move comes after a committee of secretaries headed by Cabinet Secretary KM Chandrasekhar, had recommended that the CBDT be removed from the list of agencies that can submit requests for wiretapping as tax evasion have neither criminal responsibility nor any national security issue that these were only civil cases.
The commission recommended abolition of the CBDT is the list of authorized agencies in respect of telephone tapping that the tax laws within the civil jurisdiction and are not always impinge on public safety or clarify the provisions regarding the extent monitoring has allowed the agency, including the level at which applications must be made for approval by the Minister of the Interior.
